RevivMD Terms of Use

Welcome to RevivMD (“RevivMD,” “Company,” “we,” “our,” or “us“). These Terms of Use (“Terms“) govern your access to and use of the RevivMD website, patient portal, mobile applications, telehealth platform, and all related products and services (collectively, the “Services“).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use our Services.

  1. Eligibility

To use our Services, you must:

  • Be at least 18 years of age, or the age of majority in your state of residence.
  • Be legally capable of entering into a binding agreement.
  • Reside in a state where RevivMD providers are licensed to practice or otherwise authorized to provide telehealth services.
  • Provide accurate, current, and complete information.

  1. Telehealth Services

RevivMD provides access to licensed healthcare professionals through secure telehealth technology.

Healthcare providers exercise independent medical judgment in determining whether telehealth services are appropriate for your condition.

Not every patient is an appropriate candidate for telehealth, and treatment is not guaranteed.

Providers may determine that:

  • An in-person evaluation is necessary.
  • Additional laboratory testing is required.
  • Additional medical records are needed.
  • A requested medication or treatment is not medically appropriate.
  1. No Emergency Services

RevivMD does not provide emergency medical services.

If you believe you are experiencing a medical emergency:

  • Call 911 immediately.
  • Go to the nearest emergency department.
  • Contact your local emergency medical services.

Do not rely on messaging or the RevivMD platform for urgent or emergency medical conditions.

  1. Medical Disclaimer

Information available through the Services is provided for educational and informational purposes only.

Website content does not establish a physician-patient relationship and should not be considered medical advice.

Only recommendations made directly by your licensed healthcare provider during your consultation should be relied upon for your personal medical care.

  1. No Guarantee of Treatment or Prescriptions

Submission of medical information or completion of a consultation does not guarantee:

  • A diagnosis
  • A prescription
  • A refill
  • A treatment plan
  • Continued medical care

Licensed providers maintain complete professional discretion regarding diagnosis and treatment decisions.

  1. Prescription Medications

If medically appropriate, providers may prescribe medications in accordance with applicable federal and state laws.

Certain medications cannot legally be prescribed through telehealth or may require:

  1. Payment

You agree to pay all applicable fees associated with the Services.

Charges may include:

  • Laboratory fees
  • Medication costs
  • Shipping charges
  • Applicable taxes

Unless otherwise stated, fees are due at the time services are rendered.

  1. Memberships and Automatic Renewals

If you enroll in a recurring membership or subscription:

  • You authorize recurring charges to your payment method.
  • Billing will continue until canceled.
  • You may cancel in accordance with the membership cancellation policy.
  • Fees already charged may not be refundable unless required by law.
  1. Pharmacy Services

Prescriptions may be transmitted electronically to:

  • Licensed partner pharmacies
  • Your pharmacy of choice when permitted

Once a prescription has been transmitted, fulfillment and shipping are handled by the dispensing pharmacy.

RevivMD is not responsible for pharmacy inventory, shipping delays, pricing differences, or dispensing errors.

  1. Laboratory Testing

Some treatments require laboratory testing before or during therapy.

Patients are responsible for completing requested laboratory work within the required timeframe.

Failure to complete required testing may delay or prevent treatment.

  1. Intellectual Property

All content on the Services, including but not limited to:

  • Logos
  • Trademarks
  • Graphics
  • Images
  • Videos
  • Software
  • Website design
  • Text

is owned by RevivMD or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or commercially exploited without prior written permission.

  1. Acceptable Use

You agree not to:

  • Violate any applicable law.
  • Attempt unauthorized access to our systems.
  • Introduce malware or malicious code.
  • Interfere with website functionality.
  • Impersonate another individual.
  • Submit fraudulent medical information.
  • Use automated systems to access the Services without authorization.

We do not guarantee uninterrupted, error-free, or secure access to the Services.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, RevivMD, its affiliates, providers, employees, officers, directors, contractors, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Services.

Where permitted by law, RevivMD’s total liability shall not exceed the amount paid by you for the Services giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

  1. Indemnification

You agree to defend, indemnify, and hold harmless RevivMD and its affiliates, officers, directors, employees, contractors, healthcare providers, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your misuse of the Services.
  • Your violation of these Terms.
  • Your violation of any law or the rights of another person.
  1. Suspension or Termination

RevivMD reserves the right to suspend or terminate access to the Services at any time if:

  • These Terms are violated.
  • Fraudulent activity is suspected.
  • Patient safety requires termination.
  • Required information is not provided.
  • Continued care is not medically appropriate.
  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles, except where federal law or the laws of the patient’s state of residence require otherwise.

Any legal action arising out of these Terms shall be brought in a court of competent jurisdiction, subject to any mandatory consumer protection laws.

  1. Changes to These Terms

RevivMD may revise these Terms from time to time.

Updated Terms will be posted on our website with a revised Effective Date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

  1. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

  1. Entire Agreement

These Terms, together with our Privacy Policy, HIPAA Notice of Privacy Practices, Telehealth Informed Consent, and any additional policies referenced herein, constitute the entire agreement between you and RevivMD regarding your use of the Services.
